Next Wednesday, June 1, the First Chamber of the Supreme Court of Justice of the Nation (SCJN) will discuss the constitutional controversies for the removal of immunity of the governor of Tamaulipas, Francisco Garcia Cabeza de Vaca.
According to the digital list, the projects of cases 50/2021 and 70/2021 will be analyzed in a public session by Minister Jorge Mario Pardo Rebolledo.
Controversy 50/2021 is the main case, since there is the discussion on what is established for the withdrawal of procedural immunity in the Political Constitution of Mexico.
Case 70/2021 is linked to the first and deals with the arrest warrant against Cabeza de Vaca. Both claims are led by the Congress of Tamaulipas.
The PAN member is accused of tax fraud, organized crime and money laundering.
The request to withdraw procedural immunity was submitted to the Chamber of Deputies at the end of February 2021. On April 30 in a public session, the majority of federal legislators approved the declaration of provenance solely for tax fraud.
On June 19, the FGR obtained an arrest warrant for organized crime and money laundering. The capture could not be executed since Cabeza de Vaca avoided public events. In addition, he filed an amparo before the federal judge, Faustino Gutiérrez Pérez, who gave him full protection.
